Representative Matter

One of Chicago's largest banks

Represented one of Chicago's largest banks in a lawsuit brought by a commercial borrower alleging the bank caused more than $30 million in damages and the downfall of its company when the bank improperly declared an event of default under the loan documents, failed to approve an infusion of capital through mezzanine financing, tortiously interfered with prospective business relationships and wrongfully dishonored checks. The court ruled the bank had acted in a manner consistent with the terms of the loan agreement and upheld previous rulings that any argument regarding mezzanine financing was barred by the Illinois Credit Agreements Act.
