Ann’s practice focuses on insurance, including insurance coverage litigation, claims counseling and litigation management. She has represented clients in multiparty litigation concerning insurance coverage for environmental liabilities, mass tort actions and construction defect issues. Her breadth of experience includes advice to clients at the initial presentation of the claim, representation at trial, and appellate practice.

Ann provides counseling risk management techniques and strategies to a wide range of clients including financial services companies, colleges and universities, and manufacturing companies. She has assisted clients in the review and assessment of insurance programs both prior to and after a merger or acquisition, including the use of Representation and Warranty insurance; insurance policies for Directors & Officers’ liability, and the use and formation of captive insurance companies.

Ann provided legal counsel to a client during in the development of a private label warranty program. This representation included negotiating contract terms with a Fortune 5 company and the formation of an off-shore captive reinsurance company.

Ann reviews and evaluates bonding requirements and sources on behalf of our clients. This work includes analysis of the terms and conditions of surety bonds (both payment and performance bonds) and requests for assignment of bond proceeds made by lenders and governmental entities. Representative clients include municipalities, counties, hospitals and developers, as well as lenders on multi-million dollar construction projects.

Representation of REIT in claims negotiations with insurers for property damage and liability claims.

Counsel to lender in large syndicated finance deal in negotiations with borrower’s insurance broker.

Management of 30-person review team to review electronic data on behalf of manufacturing company in response to government investigation.

Representation of hospital services client in applying a single self-insured retention to a lawsuit arising from exposure to chemicals. Attained successful settlement.

Representation of manufacturer against indemnification claims brought by processor company’s workers compensation carrier. Obtained a dismissal based on terms of the asset purchase agreement.

Representation of franchisor in obtaining status as an additional insured under franchisee’s liability policy for suit alleging bodily injury.

Counsel to national financial services client regarding changes in fidelity bond coverage.
