Matthew's practice includes all areas of EU and UK competition law. He has substantial experience with merger control (including worldwide multijurisdictional investigations), state aid, cartels, competition litigation, competition compliance/training, competition audits, market investigations and issues arising out of trading agreements and practices, such as abuse of dominance, distribution, agency and cooperation agreements between competitors. He advises main parties and third-party complainants and he has regular dealings with the European Commission, UK Competition Commission, UK Office of Fair Trading and other government bodies and regulators.

During the American Bar Association’s 2012-2013 year, Matthew will serve as vice chair of the Section of Antitrust Law’s International Committee. He is vice chair of the British Chamber of Commerce in Belgium’s Competition and Trade Task Force.

Matthew also advises in relation to EU internal market rules, including in particular free movement, market liberalization, and public procurement. He has experience in a range of other EU/UK regulatory topics, including anti-dumping, trade, sanctions, REACH and the specific regimes covering, amongst other sectors, pharmaceutical products, medical devices, veterinary products, chemicals and energy. He is a past member of the Steering Group of the UK Procurement Lawyers’ Association.

Merger Control

Counsel on various transactions subject to the EU Merger Regulation, including phase one and two clearances subject to remedies. Sectors include construction machinery, agricultural machinery, process machinery, transport, healthcare, electronic equipment and chemicals.

Counsel on various transactions reviewed under the UK merger control and public interest rules, including phase one and two clearances subject to remedies. Sectors include process machinery, transport, chemicals, defense and retail.

Counsel on various “multi-jurisdictional” merger control transactions, including obtaining clearances subject to remedies.

Counsel on appeals to the EU General Court in relation to decisions under the EU Merger Regulation.

General Competition Law including Cartels and Competition Litigation

Counsel in relation to European Commission and UK Office of Fair Trading cartel investigations, including the EU settlement procedure. Sectors include insurance, general manufacturing, removals and transport.

Advice on competition compliance and provision of compliance training and audits. Sectors include transport, general manufacturing, chemicals, FMCG and pharmaceuticals.

Advice on private damages litigation before national courts following cartel decisions.

Advice on distribution, dominance, the interface with intellectual property and other general competition law issues. Sectors include packaging, pharmaceuticals, chemicals, general manufacturing, natural gas distribution, retail, medical devices, software, gaming, FMCG and electronic equipment.

Appeal by a transport operator to the EU General Court in relation to a European Commission decision concerning alleged aid granted to one of its competitors.

Appeal by a transport operator to the EU General Court in relation to alleged aid granted to it by an EU government.

Advice on a range of infrastructure projects and privatizations.

Advice on various complaints to the European Commission.

EU Internal Market including Public Procurement and EU Regulatory

Advice on the public procurement aspects of a range of projects and privatizations. Sectors include infrastructure, defense, town center development, accommodation and energy-from-waste. 

Advice on procurement actions and appeals before national courts. 

Advice on various procurement complaints to the European Commission. 

Advice on free movement issues. Sectors include gaming and medical devices.

Advice on EU regulatory issues including in relation to natural gas distribution, REACH, packaging and pharmaceutical/veterinary product regulation.
