Renewable Energy

Our Energy lawyers are on the front lines of the high-profile, legal regulatory and business issues that are emerging in the current energy, environmental and infrastructure markets (e.g., renewable energy sources, related transactions and regulation, among others). McGuireWoods has an active practice in solar, wind, and biomass energy (the latter including biofuels, landfill gas, biomass gasification and waste-to-energy).

We represent developers, investors, industrials, utilities and customers of renewable energy facilities in connection with: (1) the development, acquisition and financing of renewable energy projects; (2) siting projects and facilities; (3) interconnection and permitting issues; (4) the purchase and sale of energy and energy commodities; (5) the purchase and sale of renewable energy companies; and (6) renewable energy project and operational capital-raising transactions.

Solar

Solar power projects, whether using concentrated solar power (CSP) or photovoltaic (PV) technology, require experience in numerous legal issues (e.g., real property and permitting requirements, construction, installation, service contracts, interconnection, power purchase, REC or carbon agreements). McGuireWoods draws upon our lawyers’ extensive experience in energy projects (renewable and nonrenewable) and, specifically, in solar power projects in which we have counseled investors, developers and lenders.

Our legal services for solar projects include assisting with the agreements and processes related to project development, siting, finance and construction. Specifically, we have worked on venture structuring; power purchase agreement negotiation and drafting; project development and financing; EPC contracting; NEPA matters; environmental permitting and review of incentives; tax structuring; regional energy market integration and participation; REC markets and carbon management opportunities.

Wind 

McGuireWoods lawyers have worked on various stages of both on- and off-shore wind projects across the country, including turbine procurement and erection; O&M, warranty, LTSA; BOP equipment procurement and construction; state siting and CPCN; power sales; REC sales; PTC and other tax issues, and project financing.

Hydroelectric

McGuireWoods has worked in various stages of hydroelectric projects across the United States and Europe. Projects have included financing, capital-raising, development, organizational, legislative, regulatory, power sales and PPAs, and EPC contracts.

Biomass

The McGuireWoods Biomass team advises clients on all forms of biomass-to-energy, waste-to-energy and biofuel, and fertilizer production projects. Our clients include owners, buyers, sellers and developers of biomass and waste-to-energy projects; lenders, investors and fuel suppliers to biomass and waste-to-energy projects; and gas, heat and power off-takers from biomass and waste-to-energy projects. We also represent numerous buyers and sellers of LFG, biomass and waste-to-energy companies. Our projects span landfills, landfill gas production and LFG-fired electric generation; open-loop and closed-loop biomass-fueled electric generation; thermal and combined heat and power plants; pellet mills; digesters and other biogas facilities fueled with animal, human and food waste streams; municipal solid waste-to-energy facilities; tire-derived fuel (TDF) projects; biomass gasification facilities, and biofuel facilities.
