Trucking company

After a two-day jury trial, plaintiff took a voluntary non-suit at the close of the evidence, before the jury was charged. The plaintiff was ejected from her vehicle on interstate 81 in Wythe County, Virginia. She filed suit against our trucking company client and their driver alleging that a tractor trailer moved into her lane, causing her to lose control of her vehicle.

Represented a chemical tanker company in a class arbitration in which the U.S. Supreme Court ruled in favor of our client on whether it is consistent with the Federal Arbitration Act (FAA) to impose class arbitration where an arbitration clause is silent on class treatment.

Defense at trial of a multinational automaker in a wrongful death case tried in Louisville, Ky. Plaintiff was seated in the front passenger seat, unbelted. She was ejected and crushed between the vehicle and a concrete barrier. Plaintiff contended the car’s door lock and latching systems were defective, allowing the door to open in the crash. After a two-week trial, the jury deliberated for just 45 minutes before returning a verdict for our client, finding there was no defect.

Firm secures appeal of no penalty enforcement action for CSX

McGuireWoods recently defended the appeal of an Illinois Pollution Control Board decision refusing to issue a penalty against CSX (one of the nation's leading transportation companies, providing rail-based transportation services) for certain environmental violations. The Illinois Attorney General's Office had appealed the board's decision - made on cross motions for summary judgment - that CSX violated the Illinois Environmental Protection Act with respect to an oil spill in its East St. Louis yard.
