Virginia Supreme Court Reverses and Renders Final Judgment Where Plaintiffs’ Liability Expert Lacked Sufficient Foundation for his Opinion.

Hyundai Motor Company, Ltd., et al., v. Keith Allen Duncan, Individually and as Guardian and Conservator for Zachary Gage Duncan, et al., Record No. 140216. On January 8, 2015, the Supreme Court of Virginia reversed a $14.140 million jury verdict against Hyundai and entered final judgment in favor of Hyundai.  The court held that the plaintiffs’ expert testimony, which was the sole support for plaintiffs’ liability theory, should not have been admitted by the trial court because it was merely the expert’s “ipse dixit assumption” and was without any evidentiary support or empirical analysis.

McGuireWoods persuaded the U.S. Court of Appeals for the 5th Circuit to affirm a grant of summary judgment previously obtained by the firm on behalf of APM Terminals in an Age Discrimination in Employment Act (ADEA) lawsuit.

Former Executive Director of a regional transportation authority

Representation of former Executive Director of a regional transportation authority in the defense of a case alleging violation of First Amendment rights under 42 U.S.C. § 1983 and violation of the Illinois Whistleblower Act. The plaintiff, a former attorney of certain pension plans and 401(k)s, alleged that his representation was terminated because he reported pension funding shortfalls and statutory violations. After filing both a motion to dismiss and a motion for sanctions the court dismissed all claims against our client and ordered full briefing on the Rule 11 sanctions motion. Matter settled, our client agreed to withdraw his motion for sanctions and the plaintiff agreed to entry of judgment in favor of our client and to waive any right to appeal.

Representation of a leading supplier of rail-based freight transportation in North America at former creosote wood treating site, beginning with negotiation of federal consent order for remedial investigation/feasibility study and continuing through the Superfund process; co-counsel in private mass tort action. Tried case to jury and forced plaintiff to nonsuit after court instructed jury regarding her failure to use a seat belt.

Virginia Supreme Court Sets New Standard For Proximate Causation In Toxic Tort Cases

Ford Motor Co. v. Boomer, 285 Va. 141, 736 S.E.2d 724 (2013). The Supreme Court of Virginia agreed that the trial court erred in its instructions to the jury on the issue of causation, in a case of first impression. The appropriate causation standard for a mesothelioma case in Virginia is whether exposure to the defendant’s product alone was “sufficient to have caused the harm.” This ruling led a victory in the retrial.
