Representation of a diversified energy producer in a 14-count case pending in Greene County, Pa., which includes claims that the seminal (CBM) Hoge case should be overturned. It includes a horizontal trespass claim based on allegations that CBM outside the main bench of the Pittsburgh seam is not part of the Pittsburgh seam and a quiet title claim related to a boundary dispute. Partial summary judgment was granted upholding the CBM Hoge decision.

Representation of a natural gas and oil company in a breach of contract and promissory estoppel case. Plaintiff alleged that client offered to enter into an oil and gas lease with plaintiff, plaintiff accepted the offer, and client later refused to enter into the lease. The alleged lease bonus payment was well above the going rate for bonuses. McGuireWoods' attorneys deposed former plaintiffs’ counsel, plaintiff, and a third-party. After uncovering detrimental facts to plaintiff’s case in these depositions, plaintiff agreed to immediately discontinue the lawsuit.

McGuireWoods secures jury verdict for BP Solar International

McGuireWoods achieved a significant jury verdict on behalf of BP Solar International Inc. in Circuit Court for Frederick County, Md. BP Solar proved to the jury that MEMC Electronic Materials Inc. and MEMC Pasadena Inc. had breached a three-year supply agreement for MEMC to provide BP Solar with silicon powder, a key raw material in its manufacture of solar modules. At the conclusion of a two-week trial, the jury awarded BP Solar nearly $9 million in damages.
