McGuireWoods helps companies protect what is theirs by drafting and enforcing effective non-compete, secrecy and confidentiality agreements. We primarily represent employers in both challenging and defending these agreements, as well as advising individual employees on behalf of the companies who seek to hire them.

In the academic arena, we provide comprehensive legal analysis and counsel in connection with negotiating license agreements, copyright and trademark matters, fair use issues related to curriculum materials, and drafting student participation agreements to protect intellectual property, among other services.

Our lawyers also counsel clients on how to negotiate settlements prior to litigation and, when necessary, we fight for their interests in court. E.I. du Pont de Nemours & Co. v. Kolon Industries, Inc., Case No. 3 :09cv58 (E.D. Va.). Represented plaintiff in a trade secrets case against Kolon Industries, a South Korean manufacturing company. After a seven-week trial, the jury found that Kolon illegally obtained information regarding DuPont's Kevlar® aramid fiber from former DuPont employees and awarded DuPont $920 million in damages.

After double-track depositions in Japan and New York, and a bi-lingual trial in New York, the District Court for the Southern District of New York, effectively defeated Texaco’s motion preliminary injunction against a Japanese engineering and construction firm against claims by Texaco for theft of trade secrets allegedly disclosed over the course of a 40-year licensing relationship.

Leading Canadian-based financial services company

Won summary judgment for a leading Canadian-based financial services company on breach of contract, conversion and unjust enrichment claims, and a directed verdict on the trade secret misappropriation claim, including a judgment limiting damages to $180,000 in this action in which plaintiff sought $70 million in damages.
