Mr. Kutrow's litigation practice ranges from business torts, securities, and intellectual property to products liability. He typically handles complex litigation involving difficult procedural or legal issues. He also assists clients with internal investigations and in responding to e-discovery and regulatory requests.
He has defended class actions in pretrial proceedings, at trial, and in appellate courts. He is also experienced in arbitration before the American Arbitration Association and securities arbitration panels, and in related proceedings in trial and appellate courts. He argued two North Carolina Court of Appeals cases that developed the standard for judicial review of arbitration awards, Carpenter v. Brooks, 546 S.E.2d 91, 534 S.E.2d 641 (2000) and Pinnacle Group, Inc. v. Shrader, 412 S.E.2d 117 (1992).

- Hospira Inc. v. AlphaGary Corp., 671 S.E.2d 7 (2009) - Defeated fraud, negligent misrepresentation, unfair trade practice, and third-party beneficiary breach of contract claims asserted against our client, a raw material supplier, by a medical device manufacturer seeking damages of more than $50 million. The Court of Appeals affirmed the trial court's grant of summary judgment for our client based on the absence of any misrepresentation to the plaintiff.
- First Care Medical Clinic, Inc. v. Polymedco (2006 WL 3497845, W.D.N.C. Dec. 4, 2006) - Achieved summary judgment on breach of contract and fraud claims in case arising from medical clinic's purchase of laboratory equipment from our client. The clinic's claims were dismissed based on its failure to prove any product defect and under the economic loss doctrine.
