Mr. Kahn has a broad commercial litigation practice that focuses on complex business litigation and products liability. He also has experience litigating wrongful death, insurance coverage, environmental, construction and employment cases. He represents clients in an array of industries including manufacturing, retail, insurance, media, financial services, information technology, and telecommunications.


Representative Matters
  • Hospira Inc. v. AlphaGary Corp., (05-CVS-6371, N.C. Super. Ct. Mecklenburg County, Nov. 8, 2007) - Defeated fraud, negligent misrepresentation, unfair trade practice, and third-party beneficiary claims asserted against our client, a raw material supplier, by a medical device manufacturer. The manufacturer sought damages of more than $50 million but recovered nothing after summary judgment was granted for our client.
  • Parks v. The Pantry, Inc., (06-CVS-956, N.C. Super. Ct. Harnett County, April 17, 2007) - Obtained a dismissal without prejudice for defendant retail convenience store client in a lawsuit alleging slander, negligent infliction of emotional distress and punitive damages for the exacerbation of a serious health condition based on a disputed report of theft. The dismissal was agreed to the day after key witness depositions.
  • Conducted investigation and pre-lawsuit mediation for insurance and day care clients of van accident that included a fatality and serious personal injuries that touched on issues of negligence, products liability, and the North Carolina seat belt law.
  • Obtained summary judgment for national hair products company in lawsuit that alleged chemical formulation of products caused personal injury. Won appeal of federal bankruptcy court ruling creating favorable law for insurer client.
  • Negotiated favorable resolution for investors defrauded by a publicly traded mortgage brokerage company and its officers.
