For the past eight years at McGuireWoods as a member of the firm's Labor and Employment Department, Mr. Greenspan has devoted his practice to litigation, client counseling, contract negotiations and workforce training.
In litigation, he represents employers in all areas of employment law, including claims of discrimination, harassment, and retaliation. Mr. Greenspan's practice also focuses heavily in the growing area of law addressing covenants not to compete. He recently obtained a jury verdict for his client in a defamation trial, and also helped obtain summary judgment for a client in a leading 4th Circuit case interpreting the Uniformed Services Employment and Reemployment Rights Act.
He works with management clients to draft employment agreements, severance agreements, and non-competition agreements. Most recently, he represented Hall of Fame NBA coach Larry Brown in his contract negotiations with the Charlotte Bobcats.
Mr. Greenspan counsels clients concerning all aspects of the employment relationship. He works with clients to address personnel issues, create effective policies and handbooks, and conduct investigations on topics ranging from allegations of employee misconduct to allegations of discrimination in the workplace. He is the Deputy City Attorney for employment matters for the City of Fairfax, and also serves as legal counsel for employment matters for the City of Manassas Park.
Among the most rewarding aspects of his work is the ongoing training he provides to clients and affiliated organizations. He has traveled the country as a presenter for private employers and municipalities on topics ranging Title VII, USERRA, non-competes, ADA, FMLA, the Fourth Amendment, and many others.
- Butler v. N.E.W. Customer Service Companies, Inc., (Fairfax County, Virginia 2007). Represented defendants in a week-long jury trial, where the plaintiff sued her former employer and individual former colleague for defamation related to statements made during the course of a government security background investigation. The jury returned a complete defense verdict for both defendants. The case is now on appeal at the Virginia Supreme Court.
- Francis v. Booz Allen Hamilton Inc., 2005 U.S. Dist. LEXIS 8159 (E.D. Va. 2005), aff'd, 2006 U.S. App. LEXIS 15578 (4th Cir. 2006). Prevailed on summary judgment in a leading USERRA case in the 4th Circuit holding that the employer did not violate USERRA when it changed the employee's hours and duties after her return from military service, and ultimately terminated her for misconduct within the "for cause" protected period.
- Pulley v. KPMG Consulting, Inc., 348 F. Supp. 2d 388 (D. Md. 2004) aff'd, 2006 U.S. App. LEXIS 13686 (4th Cir. 2006). Successfully obtained summary judgment for client under Title 42, Section 1981 of the U.S. Code, where employee failed to show that he was meeting the employer's legitimate expectations due to missed deadlines and insubordination, and failed to establish evidence of pretext even though employee engaged in protected activity just days before termination.
