Mr. Greenspan's practice is primarily focused upon defending, representing, and counseling management in employment-related issues and disputes under state and federal law. He has defended management in claims of discrimination and retaliation under Title VII of the Civil Rights Act, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Family and Medical Leave Act, and other state and federal statutes. He has also defended and prosecuted cases involving covenants not to compete. Recently, he was involved in obtaining summary judgment for a client in one of the leading 4th Circuit cases interpreting the Uniformed Services Employment and Reemployment Rights Act.

Mr. Greenspan counsels clients concerning personnel issues including reductions in force, investigations of employee misconduct, conducting internal audits for compliance with federal and state laws, and the processing of administrative charges filed with the Equal Employment Opportunity Commission and comparable state agencies. He also works with management clients to draft employment agreements, severance agreements, non-competition agreements, employee handbooks and related employment policies. In addition to client counseling, he provides onsite training courses for clients ranging in topics from "The Prevention of Discrimination and Harassment in the Workplace" to "A Brief Review of Search and Seizure Law."

Representative Matters
  • Francis v. Booz Allen Hamilton Inc., 2005 U.S. Dist. LEXIS 8159 (E.D. Va. 2005), aff'd, 2006 U.S. App. LEXIS 15578 (4th Cir. 2006). Prevailed on summary judgment in a leading USERRA in the 4th Circuit holding that the employer did not violate USERRA when it changed the employees hours and duties after her return from military service, and ultimately terminated her for misconduct within the "for cause" protected period.
  • Pulley v. KPMG Consulting, Inc., 348 F. Supp. 2d 388 (D. Md. 2004) aff'd, 2006 U.S. App. LEXIS 13686 (4th Cir. 2006). Successfully obtained summary judgment for client under Title 42, Section 1981 of the U.S. Code, where employee failed to show that he was meeting the employer's legitimate expectations due to missed deadlines and insubordination, and failed to establish evidence of pretext even though employee engaged in protected activity just days before termination.
