Chairman of the firm's Financial Services Litigation Department, Mr. Ey focuses his practice on business litigation, representing business clients in a variety of antitrust, banking, regulatory, products liability, and commercial litigation matters. In October 2005, he was named a Fellow of the American College of Trial Lawyers. He lectures frequently on litigation and professional responsibility topics.
- In re Speedway Pedestrian Walkway Failure, (01 CVS 18000, Mecklenburg County Superior Court) - Designated by the court as the defense group's liaison counsel in the first phase of this litigation that was one of the largest mass tort matters ever litigated in North Carolina. In the first trial of one of the bridge collapse cases, a directed verdict was entered for the firm's client, a chemical product manufacturer.
- Budget Pest Prevention, Inc., et al v. Bayer Corporation, et al, Case No. 1:05CV90 (U. S. District Court for the Western District of North Carolina) - Led the team that represented worldwide chemical manufacturer BASF Corporation in this antitrust action, in which the plaintiffs alleged a vertical price-fixing conspiracy regarding sales of a chemical product and sought certification of a nationwide class. Trial court granted BASF's motion for summary judgment, and the 4th Circuit affirmed, 561 F. 3d 282 (2009).
- Curtis v. Barnet, et al (10 CVS 21196 North Carolina Business Court - Mecklenburg County) - Represented nominal defendant Duke Energy Corporation and several of its current directors in a shareholder derivative action in North Carolina Business Court, which arose from Duke's 2006 sale of an interest in its indirect subsidiary, Crescent Resources, LLC. The Business Court granted the defendants' motion to dismiss.
- In re: Bank of America Corporation Residential Loans Derivative Litigation (11 CVS 4569 North Carolina Business Court - Mecklenburg County) - Represented nominal defendant Bank of America in two shareholder derivative actions in North Carolina Business Court. Plaintiff sought to assert claims that Bank of America directors and officers failed to properly prepare for and respond to an increase in defaults in its residential loan portfolio. The Business Court granted the defendants' motion to stay the cases.
- Browne v. Thompson, et al. (09 CVS 8588 North Carolina Business Court - Forsyth County) - Represents Big 4 accounting firm in claims asserted by Wachovia shareholders for losses claimed in connection with the financial meltdown and ultimate sale of Wachovia Bank. The North Carolina Business Court granted defendants' motions to dismiss in February 2011, and the matter is now on appeal.
- Represented a special litigation committee of the board of directors of a Fortune 500 financial services company in connection with that committee's investigation of allegations of wrongdoing by former officers asserted in a derivative action.
- Represented the trustees of a testamentary trust with hundreds of current beneficiaries in an action to modify certain restrictions on the administration of the trust.
- Represents a Division I athletic conference and a prominent national liberal arts college in a range of regulatory, education, faculty and student matters.
