With industry experience in the healthcare and finance arenas, Mr. Brooks focuses his practice on business litigation and creditors' rights. In corporate restructuring, he has significant experience in the representation of secured and unsecured lenders in restructurings and loan defaults. He regularly represents businesses involving preference actions, plan treatment, claim disputes, fraudulent conveyances and other matters unique to bankruptcy and distressed companies, and has represented borrowers and debtors-in-possession in a number of bankruptcies.
In business litigation, Mr. Brooks has a national practice as lead attorney in numerous trials, mediations, arbitrations and appeals around the country. He has succeeded in defeating class actions and regularly represents businesses, including several financial institutions and healthcare entities in disputes involving breaches of contract, fraud, breach of fiduciary duties, injunctions, mergers and acquisitions, antitrust violations, medical credentialing and alleged violations EMTALA and other federal laws. He has also succeeded in numerous appeals in the U.S. Supreme Court, 6th and 7th Circuits, Illinois Appellate and Supreme Courts.
