Mr. Jackson has a diverse practice that has evolved out of years of experience in all levels of risk management and high exposure litigation. He has pioneered various, alternative risk financing models for clients, and currently serves as the executive director of Virginia Senior Care Group, LLC, a risk financing group for select, long-term care retirement communities.

He is very involved in and coordinates the firm’s transportation law group, where he tries high exposure jury cases in various jurisdictions throughout the United States. He serves as the firm's resource in the general corporate representation of continuing care and assisted living retirement communities, and on the board of directors for several firm clients in this industry. He also collaborates with various other partners in the Charlottesville office and throughout the firm in representing private equity, alternative finance structures, venture capital, health care investments and hedge fund clients.

Transportation Litigation Management

Mr. Jackson has experience in all aspects of transportation litigation management, including first- and third-party claims, personal injury defense, uninsured and under insured motorist coverage, Department of Transportation audits and investigations, property damage, fire loss and arson. He has a great deal of experience with the complexities of tractor-trailer accidents and multiple-vehicle collisions, and has handled these types of cases throughout Virginia in federal and state courts. He has jury trial experience with wrongful death and severe bodily injury claims arising out of complex, multiple-vehicle pile-ups.

He is licensed in Virginia and West Virginia, and he manages associates in Maryland, D.C., North Carolina, Georgia, Illinois and Florida, to provide uniform regional defense to transportation clients.

Alternative Risk Financing Mechanisms

Mr. Jackson is the executive director of the Virginia Senior Care Group, LLC, a private insurance mechanism designed to provide various insurance coverage lines to a select group of long-term care retirement communities. This capitalized insurance program allows member entities to fund their risk exposure with owned investment vehicles, and retain the financial benefits of incident-free years. He has provided similar advice to various clients ranging from those in the transportation industry to private equity portfolio companies. Mr. Jackson’s experience in this industry has allowed many clients to transfer risk funding from the cost side to the investment side of their balance sheets.

Private Equity/Venture Capital/Capital Markets

Mr. Jackson works closely with various other attorneys and professionals within the McGuireWoods network to provide full-service legal capabilities to the growing number of private wealth and private equity clients in the Charlottesville area. Through collaboration with McGuireWoods’ New York, Washington, D.C., and Chicago offices, and with additional help from McGuireWoods Capital Group (our affiliated business consulting entity), Mr. Jackson has represented numerous clients from the Charlottesville area in private transactions throughout the United States. His efforts in this line of business have brought the full abilities of McGuireWoods’ worldwide professionals to a growing number of private equity, venture capital, and hedge fund entrepreneurs who call Charlottesville home.

Continuing Care/Assisted Living Retirement Communities

Mr. Jackson is one of the most experienced members of the firm in this area, and has been involved in all aspects of day-to-day operations of these types of facilities. Some of his experience involves incorporation, the facility and supporting foundations, tax-exempt status, acquisition and maintenance, construction finance and negotiations, debt structuring, unrelated business income opportunities, supporting subsidiary opportunities, including captive insurance and proactive risk management, residence and care contracts, Americans with Disability Act compliance, regulatory compliance, "return home" legislation, employment issues, medication errors, malpractice issues, resident relations and general business guidance.

Mr. Jackson's specialty in this arena is counseling management in its relations with disconcerted residents, and negotiations with various ombudsmen and regulatory agencies. An additional specialty that stems from his litigation practice is the implementation of risk management programs for all types of retirement facilities. He is also a member of the Virginia Association of Nonprofit Homes for the Aging, as well as the American Association of Homes and Services for the Aging.
