Mr. Vogel served as counsel to an assistant attorney general at the U.S. Department of Justice in Washington, D.C., and later as an assistant U.S. attorney in the Western District of North Carolina (Charlotte). As an assistant U.S. attorney, he prosecuted bank fraud, identity theft, mortgage fraud, money laundering, counterfeit currency, health care fraud, prescription drug misbranding, and environmental crime cases. In his role as the identity theft coordinator for the U.S. Attorney's Office, Mr. Vogel worked closely with federal and state law enforcement agencies, as well as with individuals and businesses victimized by fraud, to combat identity theft and other financial fraud crimes and to prosecute several important cases.

Today, Mr. Vogel uses his experience as a financial fraud prosecutor to help businesses avoid becoming victims and to comply with anti-money laundering (AML) and other anti-fraud or counter-terrorist financing legal requirements, including the Federal Trade Commission's Red Flags Rule for identity theft prevention and its information security requirements. He also assists businesses with internal reviews and audits, and he represents individuals and businesses in threatened or pending white collar criminal investigations and cases.

In addition, Mr. Vogel served as deputy general counsel at the U.S. Department of Education where he advised higher education policy makers and regulators on federal student aid issues. Drawing upon his experience at a senior-level of that regulating agency and upon his knowledge of some of the most complex issues arising under the Higher Education Act of 1965, as amended, and federal regulations, Mr. Vogel represents banks, lenders, guaranty agencies, servicers, and colleges. He is a frequent speaker at student lending and career college association conferences, and the author of an article published by Inside Higher Education on trends in administrative enforcement.


Representative Matters
  • Legal Compliance
    • Counseled a large grocery chain in connection with its AML compliance program and information security responsibilities.
    • Represented a leading business involved with the online game industry in seeking an administrative ruling from the Financial Crimes Enforcement Network (FinCEN) relating to AML.
    • Counseled a significant insurance company on its obligations to comply with the trade embargo statutes enforced by the Office of Foreign Assets Control (OFAC).
    • Conducted an internal audit of a large student loan company in connection with a federal regulatory compliance matter.
    • Counseled lenders and guaranty agencies on their compliance with the prohibition against inducements, including in connection with annual compliance audits and the Common Review Initiative.
  • Government Investigations
    • Represented a major wireless telecommunications company in response to a state court order seeking the content of text messages in connection with a criminal investigation.
    • Represented several former and current executives of a foreign telecommunications company in connection with a Foreign Corrupt Practices Act investigation.
    • Represented a financial services company in connection with a state attorney general investigation of telemarketers.
    • Represented a biomedical company in communications with law enforcement relating to an embezzlement matter.
    • Represented large banks with investigations by both the Education Department's Office of Inspector General (OIG) and Federal Student Aid (FSA) relating to the prohibition against inducements.
    • Represented for-profit colleges with investigations by OIG and FSA relating to incentive compensation and the 90-10 Rule.
