Ms. Kannensohn represents retail pharmacies, pharmacy benefit managers, pharmaceutical manufacturers, medical device manufacturers, physicians, physician groups, ambulatory care providers, durable medical equipment companies, group purchasing organizations, and disease management companies in corporate transactional and health care regulatory matters.
The cornerstone of her practice is providing guidance to clients regarding the Medicare fraud and abuse laws, the Stark Law, Medicare Part D, the Medicare conditions of participation, the Medicare and Medicaid program exclusion rules, the HIPAA privacy rules, and state health care laws and regulations. She has assisted numerous providers in the development and implementation of corporate compliance programs. She also represents providers in purchase and sale transactions, certificate of need matters, and the negotiation of employment, independent contractor and management arrangements.
Ms. Kannensohn has a litigation background and has represented providers in criminal and civil investigations based on alleged violations of the Medicare and Medicaid program rules. She has also represented providers in qui tam litigation based on alleged violations of the Medicare billing rules, and in post-payment audits by government and commercial payors. In this context, her clients have included clinical laboratories, chain providers of outpatient services, durable medical equipment companies, and individual physician and non-physician providers. She has represented physicians and other providers before state licensing boards, and has substantial expertise in scope of practice issues.
