Mr. Rappaport has broad experience in all types of commercial litigation, with emphasis on antitrust and unfair competition matters. He has handled numerous civil and criminal antitrust matters in federal and state courts throughout the United States. He has represented plaintiffs and defendants in cases involving price fixing, territorial and customer allocations, international cartels, tying arrangements, exclusive dealing contracts, unfair and deceptive trade practices, monopolization, and mergers and acquisitions. Many of these cases were class actions.
In addition, he has counseled clients on antitrust compliance, distribution methods, franchising, and mergers and acquisitions. He has also handled cases in federal and state courts involving breach of contract, breach of fiduciary duty, securities law violations, fraud, legal malpractice, trade secrets, trademark and copyright infringement, landlord-tenant disputes, and franchise disputes.
Further, Mr. Rappaport has significant experience in commodities litigation, including the representation of commodities dealers and traders, futures commission merchants, commodity trading advisers, and introducing brokers in matters both in federal court and before the C.F.T.C.
Prior to entering private practice, Mr. Rappaport served as a trial attorney with the U.S. Department of Justice, Antitrust Division from 1967-1969. He served as president of the Loyola University of Law Alumni Association and as a trustee of Roycemore School, Evanston, Illinois, and is a past member of the Chicago Bar Association's Judicial Evaluation Committee. He is currently a director of the American Association for Klinefelter Syndrome Information Support, a board member of the Loyola University School of Law Institute for the Consumer Antitrust Studies, and a member of the Lawyers Club of the City of Chicago.
- In re: Parcel Tanker Antitrust Litigation (United States District Court, for the district of Connecticut 2003) - representation of Jo Tankers, Inc., a carrier of liquid chemicals in parcel tanker vessels in international cartel investigation and related treble damage actions alleging price fixing and bid rigging.
- Asa-Brandt, Inc., etc., et al. v. ADM Investor Services, Inc., et al. (United States District Court for the Northern District of Iowa) - representation of ADM Investor Services in a case alleging the sale of illegal off-exchange futures contracts in violation of Commodity Exchange Act as well as fraud and breach of contract; Summary judgment granted in favor of ADM Investor Services after close of discovery
- Chesterfield Investments, et al. v. Stone Container Corporation (Superior Court, State of California) - lead trial counsel for Stone Container in an action by investors claiming a $120 million true-up payment as a result of sale of stock in a Stone subsidiary; a favorable settlement was achieved after a three-week jury trial
- Richard R. Land, etc., et al v. United Telephone-Southeast, Inc. (United States District Court for the Eastern District of Tennessee) - lead counsel for United Telephone - Southeast in a class action accusing it of monopolistic practices with regard to ancillary telephone services; United's motion for summary judgment was granted at close of discovery
