Mr. Rosen's practice primarily consists of representing businesses involved in the natural resources, environmental resources, land development, and environmental technology industries. He devotes equal time to environmental and commercial litigation practice, and environmental, corporate and commercial law counseling.
He provides complete mine development representation to several mid-sized Eastern coal producers, including siting, permitting, design, compliance and reclamation matters. He acts as special regulatory counsel to operating coal producers, including in proceedings before the Office of Surface Mining Reclamation and Enforcement, MSHA, the Department of Interior Office of Hearings and Appeals, and the U.S. district courts, involving matters related to accidents, illegal discharge, water, noise and dust pollution, reclamation standards, license and permit suspension and revocation, ownership and control permit blocking issues, designation of areas unsuitable for mining, injunctive relief and reclamation bond forfeitures.
He represents coal developers in all aspects of coal reserve leasing, sales, acquisition and title matters. He also represents coal producers in all aspects of coal supply agreement negotiation and litigation, and coal reserve acquisition and sale. He regularly negotiates Section 29 host site, feedstock and synfuel off-take, facility development and facility operation agreements, and methane gas development agreements. He has also represented coal producer trade associations on legislative issues before federal and state regulatory and legislative bodies.
Mr. Rosen also represents publicly traded and independent coalbed methane and oil and gas producers in connection with the acquisition and disposition of oil and gas interests, joint development and exploration agreements, mineral conveyancing and regulatory matters.
He is a past member of the Pennsylvania Ad Hoc Task Force on Mining Legislation, the group responsible for revising Pennsylvania's surface coal mining laws and regulations to meet the primacy requirements of the Federal Surface Mining Control and Reclamation Act of August 3, 1977. He is also a past member of the Pennsylvania Mining Advisory Committee, the group responsible for periodic amendments to Pennsylvania's surface coal mining laws and regulations; and the Environmental Hearing Board Rules Committee, the group responsible for amending the rules of procedure governing administrative law proceedings before Pennsylvania's environmental trial court. He is a frequent lecturer for the National Business Institute on environmental law topics.
