Mr. Redd focuses primarily on insurance coverage advice, negotiation and litigation. He is particularly conversant with commercial general liability, professional liability, D&O liability and property policies. His advice to clients on coverage issues ranges from negotiating policy language to representing them in seeking recovery for losses. His representative matters include complex coverage disputes involving multiple layers of coverage in multiple years, business interruption claims development and collection, advice and negotiation regarding long tail coverage implicated by potential asbestos and/or environmental liability and general analysis of and advice regarding corporate insurance programs.
Mr. Redd also focuses on real estate litigation. Formerly the president and principal of a land surveying firm, he utilizes this prior experience in the litigation of easement issues, boundary disputes and title disputes.
- Insurance
- Representation of a Fortune 500 company in persuading its carrier to provide defense and indemnity in connection with, and ultimately settle, a gunshot case in Western Kentucky.
- Representation of an entertainment/hospitality corporation in persuading its primary and excess carriers to contribute substantially to settlement of a Missouri class action brought under the Telephone Consumer Protection Act.
- Representation of a Virginia municipality against various underwriters at Lloyds of London and an associated broker on an insurance backed warranty given for the paint on a bridge.
- Representation before Pennsylvania Superior Court and Pennsylvania Supreme Court of the estate of a large bankrupt hospital corporation in a dispute over coverage among multiple excess and primary carriers who were refusing to resolve a multimillion-dollar malpractice claim. The representation entailed prevailing on the carriers to fund settlement of the underlying suit and then participating in the ensuing coverage action on behalf of the bankruptcy trustee.
- Advice to the board of directors of an institutional investment fund on the procurement of directors and officers insurance.
- Advice to a utility on whether its old general liability policies with intact long-tail pollution and asbestos coverage should be commuted in light of the state of the insurance industry, including analysis of a commutation proposal and the utility's historic coverage structures.
- Assistance to a coal marketer in having 90-95% of its defense costs paid for nuisance claims by its neighbor, resulting from movement of coal dust over a number of decades.
- Representation in West Virginia of an architectural woodwork manufacturer on its claim for business interruption associated with a fire.
- Advice regarding coverage under an OCIP agreement and various insurance policies for claims associated with alleged design flaws in the development of a water ride in Orlando, Florida.
- Representation of a North Carolina hospital group in persuading its malpractice carrier to settle a case involving a quadriplegic who claimed the hospital had broken his neck during intubation.
- Negotiation of a $100 million insurance policy to protect a concrete and gravel operation in its provision of drinking water to a West Virginia municipality.
- Recovery of approximately $1 million in business interruption losses resulting from the failure of a number of large gears in a concrete plant.
- Representation of a testing company in a declaratory judgment action in the Northern District of Illinois to obtain coverage for the loss of a rail-testing car in Texas and the associated business interruption losses. The company prevailed on summary judgment and recovered attorneys' fees.
- Negotiation of various facets of coverage, including multiple party defense cost sharing agreements, for a Fortune 200 company associated with multiple party asbestos premises liability lawsuits in Louisiana, Texas, California and Washington. The representation required retrieval of applicable insurance policies from the 1950s through the 1980s, and research of 30 years of employee records to categorize plaintiffs for coverage purposes.
- Assistance to a hospital foundation in obtaining catastrophic hospital and medical malpractice coverage.
- Creation of first draft of Side A errors and omissions policy at request of insurer.
- Real Estate
- Representation of landowner in litigation to quite title to and establish location of easement for development purposes.
- Representation of landowner against 100-year-old estate and local government in establishing boundary and quieting title.
- Representation of estate in litigation establishing easement by prescription.
- Advice to surveying company regarding resolution of gap caused by conflicting surveys of record.
- Representation of developer in dispute with surveyor over boundary location.
- Representation of fraternal order in litigation to quiet title to cemetery property.
- Negotiation on behalf of landowner to persuade neighbor to allow ingress and egress across existing road.
- Assistance on behalf of utility in administrative proceeding to determine location of exclusive service territory boundary.
- Assistance in class action litigation on behalf of utility regarding location of and rights to use of multistate easements.
- Advice to national construction products corporation in resolution of boundary disputes associated with purchase of retail location.
