Mr. Cabral represents clients throughout the United States on a variety of environmental regulatory, permitting and enforcement issues, particularly under the Clean Air Act. His clients have included utilities, mining companies, industrial and municipal entities and railroads. Under the CAA, he has advised industrial clients in numerous enforcement matters as well as on complex PSD or NSR permitting and compliance issues.

He has participated in regulatory and rulemaking proceedings before the U.S. EPA as well as many state environmental regulatory agencies, including development of SOx, NOx and mercury emissions trading programs in Illinois and Virginia. He has helped clients to obtain New Source Review permits for facilities in a number of states, including coal-fired power plants in Louisiana and Mississippi. Most recently, he has advised industrial and developer clients on various issues associated with existing and emerging state and federal climate change requirements and other greenhouse gas mandates. He has also performed merger and acquisition evaluations and asset auction due diligence for existing and emerging Clean Air Act requirements for power companies and others.


Representative Matters
  • Drafted and negotiated a groundbreaking NSR settlement valued at $1.2 billion with U.S. EPA on behalf of Dominion Virginia Power
  • Drafted and negotiated aspects of an NSR settlement between U.S. EPA and Illinois Power valued at $500 million
  • Completed PSD permitting for two coal-fired power plants, most recently the 600 MW CFB at Cleco's Rodemacher Power Station
  • Drafted and negotiated innovative regulations with the states of Virginia and Illinois to implement those states' NOx, SOx and mercury reduction programs under CAIR and CAMR
  • Filed briefs with the United States Court of Appeals for the District of Columbia Circuit appealing certain aspects of EPA's CAMR rule for mercury on behalf of a group of coal producers
  • Filed comments on several aspects of the Northeast Regional Greenhouse Gas Initiative (RGG) greenhouse gas reduction programs being developed by several RGGI member states
  • Assisted industrial clients with initial carbon-self-assessments to allow those companies to understand and better position themselves under any future carbon legislation from Congress
  • Assisted several clients in CO2 credit evaluation under Chicago Climate Exchange and other third part credit verification criteria
