Power Tools & Equipment

We have extensive experience defending some of the world’s leading power tool manufacturers in product liability litigation in state and federal courts nationwide, including serving as national trial counsel for more than 30 years to a large international outdoor power tool manufacturer. Regardless of the industry or product, we take pride in spending the time and resources necessary to fully understand the design, manufacture and use of the products we are asked to defend. We have defended claims of personal injury or property damage allegedly resulting from the use of power tools in all 50 states, in dozens of trades and industries, and originating from many different circumstances, ranging from fires and explosions, reactive/dynamic forces and exposures to benzene, silica, carbon monoxide, heavy metals, asbestos or other toxins to simple operator error or misuse of the tools or equipment.

We manage and oversee complex litigation for our power tool and equipment clients, and advise them on risk management practices and offer employee training on a broad range of risk management issues. We intercede on clients' behalf with government agencies, including CPSC and OSHA, and keep them abreast of industry developments, national and international standards, such as ANSI and ISO, and government regulations that may affect their businesses. We routinely guide our clients on product literature, warnings and instructions, marketing and advertising materials, and other information or publications that may impact the defense of their products.

Although our approach is proactive, it is also meticulous and comprehensive. Our use of technology saves time and money and allows for nearly paperless files. If significant document discovery becomes necessary, our experienced document specialists ensure that the process does not disrupt clients' businesses and is efficient and effective. We structure cases to allow for early assessment, and if consistent with the strategic goals of the client, settlement. While we have obtained summary judgments in tool and equipment cases, when trial is necessary, our seasoned lawyers bring the same sense of mission, value and results to trial that they bring to case preparation.
