Nonprofit corporation of a public university in Virginia

Defended a nonprofit corporation of a public university in Virginia in breach of contract litigation with a disgruntled research sponsor. The plaintiff alleged that a McGuireWoods client had breached a sponsored research agreement and patent license by failing to develop the plaintiff’s invention into a commercial product. The matter was tried in state court, resulting in a plaintiff’s verdict a mere fraction of the plaintiff’s demand. The matter was appealed to the Supreme Court of Virginia. The Supreme Court upheld the right of the Commonwealth of Virginia, which indemnified and held harmless McGuireWoods' client against the jury verdict, to offset the jury award against the larger amount of moneys the plaintiff owed the Commonwealth under the sponsored research agreement.
