David Kirk Writes Article on Criminal Sanctions for Financial Markets Abuse

London partner David Kirk, former chief criminal counsel at the Financial Conduct Authority, published an article titled "Enforcement of criminal sanctions for market abuse: practicalities, problem solving and pitfalls" in ERA Forum discussing regulations intended to combat abuse of European financial markets.

UK regulators implemented the Market Abuse Regulation on July 3 to increase market integrity and investor protections. The Sept. 15 article details the limitations of the regulation, challenges facing investigators and prosecutors in UK cases, the principal tools used by enforcers to detect and investigate market abuse, the importance of deterring market abuse, and the outcomes of the current regime.
