Los Angeles associate Keola Whittaker (Complex Commercial Litigation)
has co-authored an analysis of the Delaware Chancery Court’s recent rejection of a proposed settlement of class action litigation over the merger of real
estate websites Trulia and Zillow. The article, “Will Trulia Drive ‘Merger Tax’ Suits out of Delaware?”
was published in the April 29 issue of the Washington Legal Foundation’s Legal Backgrounder. Whittaker co-authored the piece with Anthony Rickey of
Margrave Law LLC.
In the piece, the authors conclude that it is too soon to tell whether the court’s January ruling will reduce the rate of so-called “merger tax” lawsuits,
or simply prompt plaintiffs to pursue their claims in courts outside of Delaware.
