Mitchell Morris, Jonathan Marx Discuss Crackdown on Hazmat Rail Shippers

Litigators Mitchell Morris and Jonathan Marx wrote an Aug. 17 Journal of Commerce column titled “DOT to crack down on hazmat rail shippers,” discussing regulators’ push for the criminal prosecution of rail shippers accused of hazmat violations.
The article details actions by the U.S. Department of Transportation’s Office of Inspector General and the Federal Railroad Administration, and
recommendations by the Department of Justice’s “Yates Memorandum” that prosecutors bring charges against individual employees in cases of corporate
wrongdoing. Together, the authors say, these actions and recommendations signal more aggressive civil and criminal enforcement for violations of rail
hazmat regulations. Morris and Marx also outline precautions for shippers to consider when confronting this new regulatory environment.
