Michael Adams Discusses Application of International Law to Cyberattacks

McGuireWoods partner and former national security advisor in the U.S. Navy Michael Adams and Megan Reiss, senior national security fellow with the R Street Institute, co-authored a Dec. 22 Lawfare blog post titled “How Should International Law Treat Cyberattacks like WannaCry

In the article, the authors reflected on the U.S. government’s general framework to identify and respond to cyberattacks and underscored the need for clarity and additional analysis on cyber law.

Highlighting how recent cyberattacks mark a shift “in our understanding of the roles, responsibilities and authorities of states and non-state actors in cyberspace,” the authors noted ongoing confusion around what legal thresholds are applicable to cyberattacks. They also outlined challenges policymakers face in clarifying how international law applies to cyberspace operations.
