Philip — former managing partner of the firm’s New York office for over 8 years — is a nationally recognized litigator with extensive mass torts (asbestos), products liability and commercial litigation experience.  Among his many honors, Phil has been recognized for his client service excellence for commercial litigation as a BTI Client Service All-Star for 2016. With a unique depth of experience, he litigates in a wide range of high-profile industries and business sectors in Federal and State Courts and arbitration/mediation proceedings throughout the United States, including mass torts and product liability, complex commercial litigation and energy. He has acted for several years as national counsel for Fortune 300 companies in asbestos litigation pending throughout the United States and addressed various issues associated with that litigation (including indemnification disputes and insurance coverage issues).

During his career, Phil's experience derives from acting as lead counsel in high-profile mass tort and complex commercial cases. He acted as a defense liaison counsel in litigation pending in the United States District Court for the Southern District of New York brought by clean-up workers alleging injuries related to their work in buildings after the September 11th terrorist attacks. He has also acted for many years as a liaison counsel for the New York City Asbestos Litigation (NYCAL) medical defense group, a group which oversees medical and other major issues faced by defendants in the NYCAL.

Served as national counsel for major companies in defense of thousands of asbestos-related claims throughout the country. Handled cases directly in the NYCAL, managed nationwide local counsel network, developed and implemented strategies for handling of cases, engaged in settlement negotiations with key plaintiff counsel throughout the U.S. and address other related issues such as indemnification and insurance coverage disputes.

Handled litigation defending mass tort claims pending in the United States District Court, Southern District of New York, brought by clean-up workers after the September 11th terrorist attacks.  Act as one of a handful of defense liaison counsel tasked with managing the litigation (including well over 1,000 claims) on behalf of the defense group.   

Handle litigation and counsel clients related to a variety of contractual and business tort disputes, including claims related to alter ego/piercing the corporate veil.

Successfully prosecuted proceeding in state court in Albany on behalf of major company challenging order of New York Public Service Commission related to disposition of corporate assets.

Handle client litigation/arbitrations and counseling related to stock purchase and asset sale agreements (particularly indemnification and assumption of liabilities) in various industries.

Advise on litigation/arbitration related to gas royalty disputes, including complex class actions and related proceedings.

Handle litigation/counseling in mineral rights disputes.

Representation of generating company related to environmental compliance and permitting issues for power generating stations, including complex issues under the federal Clean Water Act and defense of citizens’ suit claims.
