Mark Johnson focuses his practice on energy regulation and restructuring. He routinely advises energy clients on a variety of regulatory and litigation matters, including traditional and performance-based formula ratemaking, Smart Grid, energy efficiency, renewable energy, distributed generation and net metering, clean coal, energy procurement, utility restructuring and competitive market development, municipal aggregation, and financing. Mark also devotes a substantial portion of his practice to counseling clients on the preparation, implementation and interpretation of legislation related to these issues.

In addition to his energy practice, Mark has substantial experience in the areas of white collar crime and antitrust litigation and counseling. He has represented audit committees of Fortune 500 companies in internal investigations of alleged accounting irregularities, as well as provided counsel to various financial market participants in connection with regulatory proceedings before the NASD and CFTC. He has also defended software and pharmaceutical companies in matters involving alleged antitrust violations and provided ongoing antitrust counseling.

Traditional and Formula Ratemaking Cases

Represented an electric utility client in a variety of ratemaking cases, including the first formula ratemaking cases under Illinois’ Energy Infrastructure and Modernization Act.

Energy Efficiency Portfolio Plans

Since the inception of Illinois’ Energy Efficiency Portfolio Standard in 2007, represented Illinois’ largest electric utility in the approval of its triennial energy efficiency plans. The current plan (2014-2017) involves the administration of a nearly $500 million portfolio of energy efficiency programs. He also serves as counsel in related annual proceedings addressing cost recovery and evaluation, measurement, and verification of energy savings, and has also served as counsel in the approval of the utility’s on-bill financing program for energy efficiency measures.

Competitive Electricity Market Proceedings

Represented an electric utility in various proceedings addressing the expansion of the competitive retail electric market in Illinois, including:

  • Purchase of Receivables Program: Represented an electric utility client in the approval of its purchase of receivables program, and provides ongoing counsel regarding implementation and cost recovery issues.
  • Municipal Aggregation: Served as counsel to an electric utility client regarding the Illinois Commerce Commission’s adoption of rules regarding municipal aggregation.
Legislative and Regulatory Counseling

Routinely provides counsel to energy clients regarding analysis, drafting, and implementation of legislative proposals and strategy. His broad experiences covers virtually every aspect of electricity regulation, including traditional and performance-based formula ratemaking, energy efficiency, Smart Grid and Advanced Metering Infrastructure, renewable energy portfolio standards, net metering and integration of distributed generation, electric supply procurement, clean coal, competitive market development, rate design, and financing.
