Served as local counsel for Plantation Pipe Line Co. in an appeals case with the Texas Supreme Court. The Court refused to hear an appeal of a lower-court ruling which held that Plantation Pipe Line Co. did not forfeit coverage under an excess insurance policy when it settled claims with primary insurers over a 1975 oil leak in North Carolina. The high court’s refusal to take the case upholds Plantation’s 2014 victory in the Court of Appeals for the 11th District of Texas, a decision which bucked a national trend favoring insurance carriers on this issue.

No state agency approval required; however, certain post-closing filings are to be made with the FERC and with the U.S. Treasury Department with respect to certain funds and tax credits received by seller for the two facilities under the American Recovery and Reinvestment Act of 2009.

In its precedent-setting opinion, the court analyzed Rule 23 requirements and definitively placed the burden first on plaintiffs to meet those requirements and then on the district court to analyze them robustly.
