Partner Richard Mason and senior counsel Patricia Smoots wrote the article “Liability to Third Parties for Lost or Damaged Property,” which was published in the December 2011 issue of the Journal of the National Association of Bankruptcy Trustees. The article discusses the circumstances under which bankruptcy trustees or bankruptcy estates might incur liability in connection with handling property in the estate’s possession that is owned or claimed by non-debtors.
