On June 25, EPA issued an updated risk assessment for TCE that identifies possible health risks to consumers and workers. Just two days later, the National Toxicology Program released a draft report recommending that TCE be reclassified as a known human carcinogen.

In light of recent risk analyses concerning trichloroethylene (TCE) and potential fetal toxicity, we may face tightened groundwater, soil and vapor intrusion standards for the chemical.

TCE is present at tens of thousands of contaminated sites across the country. The changing science may spark a new wave of toxic tort and indemnification litigation and may influence development decisions. With TCE’s potential to affect indoor air quality, the new science also may impact workplace health and safety requirements.

McGuireWoods LLP and AlterEcho discuss the new risk analyses and their legal and business implications.
