On Jan. 12, 2010, partner Jay McElligott (Tax and Employee Benefits, Richmond) spoke on “Retiree Health Benefit Plans: Modifying and Terminating Legacy Benefits,” a webinar that was broadcast nationally by Strafford Publications. He discussed criteria for determining whether retiree medical benefits have vested under ERISA and collective bargaining agreements, as well as related litigation and bargaining issues such as class actions, reverse class actions, jury trials, selection of venue, impact of bankruptcy, and funding for benefits under VEBAs.
On Feb. 5, 2010, McElligott led a discussion on the impact of the Supreme Court’s 2008 MetLife decision on discovery and adjudication of ERISA benefit claims at the mid-winter meeting of the Employee Benefits Committee of the American Bar Association Section of Labor and Employment Law in San Antonio, Texas. The discussion covered discovery, conflicts of interests, and adjudication of claims.
