Representation of leading global provider of components, systems and services used in heating, air conditioning, commercial cooking/refrigeration, and residential thermostat products in a lawsuit for personal injuries and property damage arising from a gas explosion, allegedly as the result of a defective control valve on a water heater, resulting in severe burns to nearly 90 percent of plaintiff’s body. The plaintiff and his insurer filed suit, seeking more than $11M in damages. The District Court granted our client's Daubert motion striking plaintiffs’ primary liability expert witness and granted summary judgment on all claims. The Sixth Circuit Court of Appeals issued a 10-page ruling affirming summary judgment. The Sixth Circuit Court of Appeals later denied plaintiff’s motion for re-hearing.
