McGuireWoods Washington, D.C., partner George Terwilliger (Government Investigations and White Collar Litigation) was quoted in a Sept. 28, 2016, column in The Am Law Litigation Daily that previewed cases to watch in the upcoming U.S. Supreme Court term.
In the column, Terwilliger discussed a Colorado jury bias case, Pena-Rodriguez v. Colorado. Terwilliger said the bar for overturning cases on such matters must be high or jury verdicts would lack finality. “If the door were opened to getting into that, lawyers would be bound to investigate what took place in the jury room and look for those kind of mistakes. The objective of finality would be lost,” he said. “My own view … is that if there is going to be any exception, it will have to be an extremely narrow one with a very high threshold.”
