Dan Bumpus Counsel

Dan Bumpus utilizes his experience in both the public and private sector to advise clients on legal and policy issues before state and federal administrative agencies, including the Virginia State Corporation Commission and the Federal Communications Commission. He also regularly counsels clients on regulatory and compliance issues related to data protection.

Administrative Litigation

Dan served as Associate General Counsel in the Virginia State Corporation Commission’s Office of the General Counsel from 2018 to 2020. In this role, he counseled the Commissioner of Insurance and the Financial Regulation and Life & Health Divisions of the Bureau of Insurance on legal and policy issues.

Dan utilizes his administrative litigation experience to advise electric and natural gas utility clients in complex regulatory litigation, discovery issues, codes of conduct and affiliate transactions, and other regulatory compliance matters.

Communications Regulatory and Data Privacy & Security

Prior to joining McGuireWoods, Dan was an associate at an international law firm in Washington, DC, where he focused his practice on advising media and tech companies, hedge funds, private equity firms, and other clients on Federal Communications Commission (“FCC”) compliance and regulatory issues related to data protection.

Dan represented clients before the FCC on a wide range of regulatory issues, including accessibility, spectrum, open Internet, emergency communications, retransmission consent, and privacy.

Dan counseled clients on regulatory changes and structured compliance programs with HIPAA, COPPA, GLBA, FCRA, GDPR, and other international data protection laws. He also advised clients and drafted policies and procedures to respond to data breaches, including drafting breach notifications and coordinating response with regulators.

Experience

Counseled the Virginia’s Commissioner of Insurance and its Bureau of Insurance on legal and policy issues, including:

  • Led investigation and enforcement proceedings of unlicensed insurers
  • Advised the Bureau’s Special Deputy Receiver for Virginia insurance companies in receivership
  • Drafted, reviewed, negotiated, and commented on insurance legislation before the Virginia General Assembly
  • Led legal review of transactions involving Virginia-licensed insurance companies

Counseled video programming distributor, broadcaster, programming networks, Internet service provider, wireless provider, equipment manufacturers, trade association, and other clients on FCC compliance, including:

  • Drafted comments and counseled ISP and wireless provider on changes to open Internet rules and drafted revised broadband transparency disclosures for fixed and wireless offerings
  • Advised client launching new MVNO wireless service
  • Counseled client on accessibility requirements for new product design including voice remote and audible guide on set-top box
  • Drafted petition for declaratory ruling on providing notice via electronic means; advised client on appropriate course of action to obtain favorable ruling from FCC
  • Counseled broadcaster and cable programmer on accessibility requirements of new video description rules

Advised tech companies, hedge funds, private equity firms, and other clients on regulatory and compliance issues related to data protection, including:

  • Advised clients on changes to practices related to adoption and implementation of GDPR
  • Monitored regulatory developments and advised client on implementation of location tracking technologies in the United States and EU
  • Counseled client on international data protection concerns related to its foreign pharmaceutical testing; helped create privacy program for data collection and dissemination
  • Counseled multinational clients on international data protection issues related to internal investigations
  • Advised clients investigating data breach, including coordinating response to regulators
