For more than 25 years, Richard has advised U.S. corporations with regard to a wide variety of complex labor relations matters, such as large-scale union organizing and decertification campaigns, strikes and secondary boycotts, union jurisdictional disputes, and successor employer claims.
He has worked closely with management on labor relations strategies related to new facilities, plant closings and consolidations, as well as during acquisitions and divestitures.
Richard was lead counsel in what is believed to be the largest successful decertification campaign in U.S. history. He has successfully argued numerous traditional labor cases before U.S. Circuit Courts of Appeal, has appeared before more than 15 regions of the National Labor Relations Board, and has spoken at conferences for the National Academy of Arbitrators and other prominent groups.
In addition to his work in labor-management relations, Richard has a great deal of experience handling wage and hour matters, employment discrimination claims, and restrictive covenant cases. He was a contributing editor on the treatise Covenants Not To Compete: A State-by-State Survey (BNA Books, 1991).
Richard is a contributing editor to the ABA's Developing Labor Law.
Chambers USA rates Richard as a leading Georgia labor and employment lawyer. In 2013 and 2014, Legal 500 recognized Richard as one of the nation's leading lawyers in the area of labor management relations. He has been named a Georgia Super Lawyer by Atlanta Magazine. Richard was also recognized in Corporate Responsibility Magazine’s 2014 Legal Who’s Who for his work in employment law.
Represented The Boeing Company in connection with repeated representation matters before the National Labor Relations Board in which the International Association of Machinists, filed petitions seeking to represent 3,000 mechanics at the company’s Charleston, South Carolina manufacturing facility.
Represented a major automotive manufacturer in connection with matters before the National Labor Relations Board in which the United Auto Workers filed a petition seeking to represent 3,800 mechanics at a large southern manufacturing facility; and, successfully defended numerous unfair labor practice charges filed in connection therewith.
Represented The Boeing Company with respect to labor issues surrounding its decision to build a final assembly line for the 787 Dreamliner commercial aircraft. The International Association of Machinists filed charges with the National Labor Relations Board claiming that Boeing's selection of the new site in Charleston, SC over an existing facility in Everett, Washington violated the National Labor Relations Act.
Represented The Boeing Company in a representation matter before the National Labor Relations Board in which the Society of Professional Engineering Employees in Aerospace, IFPTE Local 2001, filed a petition seeking to represent certain classifications of pilots and simulator trainers located in the State of Washington.
Represented The Boeing Company in a representation matter before the National Labor Relations Board in which the Society of Professional Engineering Employees in Aerospace, IFPTE Local 2001, filed a petition seeking to represent all of the Company’s Field Service Representatives working throughout the United States as part of an existing unit of engineers working within the State of Washington.
Represented Foxwoods Resort Casino in disputes over the applicability of federal labor law to on-reservation activities of Native American tribes.
Represented Foxwoods Resort Casino in the organizing, negotiation of the collective bargaining agreement, and interest arbitration between the casino and the bartenders and beverage servers.
Represented The Home Depot in proceedings before the NLRB.
