Insured’s Response to Environmental Liability

The American Bar Association’s Tort, Trial and Insurance Practice Section just published its latest treatise, Environmental Liability and Insurance Recovery. The book covers various environmental claims and how insurance covers them. Collin Hite and Kevin O’Brien authored Chapter 12, “Insured’s Response to Environmental Liability.” This chapter focuses on how policyholders should respond to environmental claims in order to ensure they received the insurance coverage their companies desire under various policies. As the introduction notes, “The financial consequence of environmental liability is potentially enormous. In 2008, for instance, the top three thousand publically traded companies accounted for $2.15 trillion of global environmental damage.”
