Recent IRS Guidance on Post-Windsor Spousal Benefits in Retirement Plans

The Internal Revenue Service issued new guidance on April 3 addressing the impact of the Supreme Court’s decision in United States v. Windsor on same-sex spousal retirement benefits. Although it was clear from the court’s June 26, 2013 decision that same-sex marriages would be recognized for all federal purposes post-Windsor, administrative and operational questions remained for retirement plans.

The IRS guidance covers both operational issues and plan amendment requirements. The webinar provides plan sponsors with the information needed on how their plans are affected, what steps need to be taken, and what communications should be made to employees.
