July 19, 2016

Bloomberg BNA Webinar

Partner Brian D. Barger and Counsel Robert F. Holland provided a complete overview of new Sex Discrimination Guidelines published by the Office of Federal Contract Compliance Programs (OFCCP) in this webinar.

The rule substantially revises the OFCCP’s prior 1970s-era Sex Discrimination Guidelines for federal contractors and subcontractors covered by Executive Order 11246, and is effective August, 15, 2016.

A preview was provided of coming litigation attractions that are relevant for all employers (regardless of whether an employer is a federal contractor).

Key issues and challenges were discussed regarding OFCCP’s position on such topics as:

  • Pregnancy bias
  • Workplace accommodations for pregnant workers
  • Caregiver protections
  • Pay practices
  • Work assignments
  • Sex stereotypes and sexual orientation and gender identity discrimination
