Partners Richard Holzheimer and John Wilburn will be speaking on the topic “What’s Yours is Mine: The Challenges and Law of Eminent Domain in Energy Production and Transportation” at this event presented by the Institute for Energy Law and the Energy & Mineral Law Foundation (EMLF).
In eminent domain proceeding, landowners vigorously challenge a company’s right to condemn as a tactic to forestall the condemnation. The attacks are typically focused on (i) the validity of the certificate of public convenience and necessity, (ii) the necessity of the property rights sought, and (iii) whether adequate negotiations occurred. The speakers will discuss defenses to those challenges and proactive measures and policies companies can implement early on to ensure success.
