Peter advises clients on compliance with federal, state, and local employment laws, simultaneously crafting solutions that minimize their risk of future litigation with solutions aligned to their business objectives.
Peter partners with clients to develop a comprehensive, hands-on approach to employment related matters they may face, ranging from labor code violations, wage and hour violations, discrimination, harassment, and retaliation.
Peter has represented employers for a decade in a wide variety of industries and has obtained favorable results, including successfully defeating class certification, winning on summary judgment, and negotiating favorable settlements. Peter’s experience with clients across various industries has given him a deep understanding of each sector’s intricacies, nuances, litigation challenges, and business operational needs.
Experience
- Defended national hospitality and entertainment company in wage and hour class action in U.S. District Court for the Southern District of California alleging failure to pay minimum wage and overtime, failure to provide meal and rest periods, and related wage and hour derivative claims; successfully defeated class certification and resolved individual claim for nuisance value.
- Defended public entity in case filed by white male employee alleging reverse discrimination, harassment, and retaliation under FEHA; obtained summary judgment of all claims and full dismissal of case.
- Defended national retail store in single-plaintiff case alleging disability and pregnancy discrimination, harassment, and retaliation under FEHA and California Labor Code Section 1102.5; obtained order granting motion to dismiss without leave to amend on statute of limitations grounds.
- Represented international advertising agency in high-profile single-plaintiff age discrimination, harassment, and retaliation case filed by executive; retaliation claims successfully dismissed on summary judgment.
- Defended skilled nursing facility against claims of age discrimination, constructive termination, wrongful termination in violation of public policy, failure to provide meal and rest periods, failure to provide accurate wage statements, waiting time penalties, and unfair competition; obtained dismissal of age discrimination and termination related claims on summary judgment.
- Defended international pharmaceutical company against various wage and hour claims before the California Labor Commissioner; obtained ruling in favor of employer dismissing claims on ERISA preemption grounds.
