Air & Water Regulatory Counseling and Enforcement

McGuireWoods’ air and water regulatory counseling and enforcement practice work with the Environmental Protection Agency (EPA) headquarters and regional offices, state agencies and legislative bodies to help clients address permitting challenges, respond to enforcement actions and navigate evolving regulatory frameworks.

Our air regulatory work includes advising on major source permitting, Title V operating permits, compliance certifications and mitigation strategies under the Clean Air Act. We have successfully obtained and defended permits for major energy facilities, defended clients in state and federal enforcement actions, and represented industry participants in rulemaking proceedings and judicial reviews — including before the D.C. Circuit and U.S. Supreme Court — in major Clean Air Act rulemaking involving pollutant emissions and greenhouse gas regulation.

On the water side, the team assists public and private clients with permitting, compliance and enforcement involving water supply, wastewater treatment, stormwater, wetlands, groundwater protection and related infrastructure development. Our work includes supporting participation in the legislative and rulemaking processes, managing complex permitting for construction and operation, and advising on administrative enforcement and citizen suits.
