McGuireWoods’ Adam Penman Writes on Attention Deficit Issues Employers Face

McGuireWoods London associate Adam Penman wrote an article about employers’ duties to workers with Attention Deficit Hyperactivity Disorder that appeared Jan. 8, 2026, in People Management, a publication of the Chartered Institute of Personnel and Development.

Penman noted that some cases in the United Kingdom regarding employees with ADHD and employer accommodations “yielded perhaps unusual outcomes,” such as an employee winning a discrimination claim arising out of her absentmindedness after becoming intoxicated at a company event. He emphasized that “what qualifies as a ‘reasonable’ adjustment will turn on all of the circumstances” in a matter.

“The increasing visibility and prevalence of ADHD and the trajectory of current case law indicates that employers need to be more informed of the disorder (perhaps including the benefits of the same), more alert to the issues, earlier with proactive inclusion and open to tailored adjustments to mitigate risks of disability-related discrimination,” Penman concluded.
