McGuireWoods’ federal energy regulatory commission team represents electric and gas utilities as well as independent developers, trading firms and institutional investors in all aspects of FERC practice. The team includes a former FERC commissioner and Department of Energy official, former senior FERC staff officials and practitioners with former in-house experience, enabling us to offer clients deep agency insight. We advise on compliance, routine filings and complex administrative litigation, drawing on decades of experience helping clients navigate regulatory frameworks and advance their strategic goals. Our team appears before FERC on behalf of transmission owners, generation owners, independent developers, trading firms, vertically integrated utilities and coalitions of energy companies with common interests.

We represent transmission owners in matters involving transmission cost-of-service recovery, planning and cost allocation, and interconnection matters within and outside of organized markets. On the generation side, we advise utility-affiliated and independent power producers on interconnection agreements, market-based rate authority, cost-based rate recovery and compliance issues under market rules, including reliability-must-run scenarios and structured wholesale power purchase agreements. The team has a best-in-class energy enforcement practice facing FERC and the CFTC. Our lawyers also assist with rulemakings and litigation matters involving pipeline certification, natural gas tariffs, service modifications and related regulatory obligations.

In partnership with McGuireWoods’ Energy Mergers & Acquisitions and Finance Practice Group, we advise on regulatory implications of deal structures, conduct due diligence and prepare FERC-related transactional filings, including Section 203 applications.
