Josh is an associate in the firm’s Commercial Litigation department. His practice spans a wide range of civil disputes, with focuses on complex litigation involving distressed or insolvent entities, insurance recovery, creditors’ rights litigation, financial-fraud and mass-tort actions, and asset-recovery litigation in bankruptcy and state-court receivership proceedings. Josh also maintains non-litigation practices in the areas of data privacy and corporate/financial restructuring.

Josh is a fluent Spanish speaker and maintains a pro bono practice representing clients in immigration proceedings. Prior to joining the firm, Josh clerked for bankruptcy judges in the Northern District of California and Northern District of Florida.

  • Represented publicly traded distributor in mass-tort litigation and related insurance-recovery disputes involving multiple simultaneous proceedings in state and federal court.
  • Represented major financial institutions in connection with Ponzi-scheme and other mass-fraud litigation in state and federal court.
  • Defended major financial institution in complex litigation involving state-court receivership within marital dissolution proceeding.
  • Represented liquidating trustee of insolvent multi-national enterprise in connection with asset-distribution disputes and creditors’ rights litigation.

Data Privacy

  • Assist clients in complying with rapidly developing state-law data privacy laws and regulations.
  • Advise clients in adopting policies and procedures to address litigation risks associated with biometric data and state and federal wiretapping laws.

Restructuring

  • Advised natural gas distributor in connection with winddown of interstate pipeline project.
  • Advise clients in navigating bankruptcy process of corporate affiliates.
