Andrew is a partner in the firm’s Chicago office and a member of the Insurance Recovery Group. He represents corporate policyholders in complex, high-stakes insurance coverage disputes in state and federal courts and in arbitration nationwide, and has helped clients recover more than $200 million from their insurers. He has tried cases to verdict in Illinois and Texas and is a member of the Trial Bar of the Northern District of Illinois.
Andrew’s practice encompasses a broad range of insurance coverage matters, including commercial general liability, cyber and data breach liability, directors and officers (D&O) liability, employers’ liability, employment practices liability (EPL), errors and omissions (E&O) and professional liability, excess and umbrella liability, fiduciary liability, property damage and business interruption, and representations and warranties insurance. He also advises clients on contractual indemnity and risk transfer, often coordinating those claims alongside insurance recovery strategies. He represents clients across various industries, including manufacturing, logistics, energy, agriculture, commercial real estate, healthcare, and media, and has handled significant matters involving product liability, environmental liabilities, and other complex commercial risks.
Beyond his disputes practice, Andrew advises clients on coverage issues in connection with policy renewals and commercial transactions. He is a frequent author and speaker on developments in insurance coverage law.
- Represented a Fortune 100 energy company in a coverage dispute over additional insured status under a contractor’s commercial general liability policy for an injury at a refinery, obtaining a published decision from the Illinois Appellate Court on an issue of first impression.
- Represented a global flavor manufacturer in coverage litigation under CGL and excess policies for more than 200 underlying lawsuits alleging progressive pulmonary injury from diacetyl exposure, obtaining rulings
establishing a single occurrence, application of a continuous trigger, and the insurer’s breach of its duty to defend. - Represented a global pork producer in a coverage dispute against primary and excess carriers over CGL and business auto coverage, seeking recovery of defense costs and settlement amounts arising from high-profile nuisance lawsuits over its hog farming operations, and obtaining summary judgment rulings on the duty to defend and estoppel.
- Represented a national media company in an action to recover defense costs under an employer’s liability policy for underlying litigation arising from a high-profile workplace violence incident, establishing the insurer’s breach of its duty to defend and the insureds’ right to independent counsel at the insurer’s expense.
- Represented a national staffing company in the pursuit of coverage under cyber and employment practices liability policies for multiple class actions alleging violations of the Illinois Biometric Information Privacy Act.
- Represented a warehousing and logistics company seeking additional insured coverage and contractual indemnity for a wrongful death claim arising from an incident at its facility, obtaining favorable rulings on both.
- Represented a transportation equipment company in an arbitration seeking contractual indemnity and additional insured coverage from a manufacturer and its insurers for an underlying wrongful death action.
- Represented a chemical manufacturer in coverage litigation against its umbrella and excess carriers over indemnity for an EPA Superfund remediation claim, involving trigger of coverage and allocation of long-tail environmental liability.
- Represented a food manufacturing company in a five-week jury trial concerning first-party property, business income, and extra expense coverage for losses arising from an ammonia explosion at its processing facility.
- Represented the owner and manager of a Chicago high-rise commercial building in connection with claims for property damage, business interruption, extra expense, and bad faith arising out of a fire that displaced dozens of tenants.
- Represented a global packaging components manufacturer in coverage litigation against its excess property insurer over unpaid property damage and time element losses arising from a fire at an overseas manufacturing facility.
- Represented a Fortune 500 manufacturer in the pursuit of business interruption and extra expense coverage under an all-risk property policy for pandemic-related losses across a global portfolio of insured locations.
- Represented an oilfield services company in a successful cyber coverage claim for business interruption and digital asset losses arising from a ransomware attack.
- Represented a municipal risk pool in a multi-week reinsurance arbitration and subsequent federal court proceedings arising from its reinsurer’s refusal to fund the settlement of a catastrophic injury claim.
- Representing former directors in the pursuit of coverage under fiduciary liability and Side A DIC policies for ERISA co-fiduciary claims arising from an ESOP transaction.
- Representing a municipality in the pursuit of coverage under primary and excess liability policies following a substantial excess verdict in a
wrongful death action. - Representing a property manager in a coverage dispute with its excess liability insurers over coverage for underlying fire-related liabilities.
