Prince William County Extends Special Use Permit Validity

On April 7, 2026, the Prince William Board of County Supervisors approved a resolution extending the validity of all special use permits (SUPs) that were valid on July 1, 2025, until 11:59 p.m. on July 1, 2028.

Under Prince William County’s standard rules, an approved SUP generally remains valid for up to five years after the final site plan is approved by the county. Over the past 16 years, the Virginia General Assembly has taken several actions to extend the validity of certain approved SUPs, including through Virginia Code Sections 15.2-2209.1 and 15.2-2209.1:1. However, those extensions ended on July 1, 2025. The Prince William Board of County Supervisors’ action is a response to the end of the state level extensions.

The three-year extension is intended to provide property owners and developers with a reasonable amount of time to complete their projects. Owners and developers with approved SUPs in Prince William County should confirm that their approvals were valid as of July 1, 2025, to ensure eligibility for the extension and should plan accordingly to meet the new July 1, 2028, deadline.
