Federal Energy Regulation

Clients across the energy value chain, including electric generators, energy marketers, large commercial energy users, wholesale power suppliers, and interstate natural gas pipelines, rely on Mustafa for guidance on nearly every aspect of FERC regulation. His practice encompasses matters arising under the Federal Power Act, Natural Gas Act, Natural Gas Policy Act, Public Utility Regulatory Policies Act of 1978 among others.

Mustafa regularly advises electric market participants on the complex and evolving rules governing market participation within Independent System Operators and Regional Transmission Organizations (ISOs/RTOs) across North America. He also represents clients in complex regulatory proceedings, administrative litigation and rulemakings before FERC.

Energy Transactions and Commercial Agreements

Mustafa’s regulatory counsel is grounded in a deep understanding of energy markets and commercial operations. He has significant experience preparing and negotiating complex and novel agreements involving a broad range of energy products and infrastructure.

His experience includes power purchase agreements for wind, solar and battery storage resources; industry-standard master agreements, including EEI, WSPP, ISDA and NAESB agreements; energy management and natural gas asset management agreements; natural gas pipeline precedent agreements; and liquids pipeline throughput and deficiency agreements.

This transactional background enables Mustafa to identify regulatory considerations early, address risk within commercial terms and help structure agreements that advance clients’ business objectives while withstanding regulatory scrutiny.

Compliance, Investigations and Enforcement

Mustafa helps energy companies establish effective compliance programs, identify potential risks and respond strategically when issues arise. He develops compliance policies, training programs and risk assessments tailored to each organization’s operations, market activities and regulatory exposure.

When clients face investigations or enforcement matters, Mustafa draws on significant experience representing companies before FERC, ISO/RTO market monitoring units, the Commodity Futures Trading Commission (CFTC) and NYMEX. His counsel is informed by his prior service in FERC’s Division of Investigations, giving him firsthand insight into how regulators evaluate conduct, develop investigations and assess potential violations.
