Kang is a trial lawyer who litigates high-stakes commercial disputes for publicly traded REITs, national property developers, construction companies, data center developers, Fortune 500 hospitality corporations, public utilities, and Fortune 500 government contractors.
These clients trust Kang not only with litigation and taking their cases to trial, but with transactional matters and risk management. Drawing on his experience with hotly-disputed commercial litigation matters, including preliminary injunction hearings, trials and appeals in both state and federal courts, Kang also drafts and negotiates commercial agreements, counsels clients through potential disputes before they mature, and delivers practical business guidance that keeps clients out of the courtroom entirely so they can focus on delivering results to their shareholders. A published thought leader, Kang is the lead author of a peer-reviewed article, published in an international academic journal, about the importance and impact of risk allocation clauses in commercial contracts. Kang has also argued before the Fourth Circuit Court of Appeals.
His ability as a senior associate to originate relationships with Fortune 500 corporations and publicly traded companies reflects Kang’s strengths in managing cases from start to finish and delivering results efficiently while understanding the commercial realities and risk tolerances that drive decision-making for sophisticated corporate clients. In fact, very early in his career, Kang served as the lead associate for a massive litigation project that involved over 300 cases filed throughout four district courts within the Fourth Circuit.
Kang brings creative advocacy to every engagement. He has convinced the Supreme Court of Virginia to interpret “and” in the disjunctive, pierced corporate structures through alter ego theories to force favorable settlements, and leverages his deep knowledge of contract interpretation principles to achieve favorable rulings or settlements at the motion-to-dismiss phase for contract disputes. He has also argued various issues of first impression under the federal Torture Victim Protection Act, a niche intersection of international human rights law and civil litigation. From what he has learned through litigation and exploring his curiosity by reading cases, treatises, and law review articles, Kang routinely advises clients and industry groups within the firm on contract-drafting nuances and strategies.
Before joining McGuireWoods, Kang practiced labor and employment law for a national firm and clerked for the Honorable John M. Tran of the Fairfax County Circuit Court. Clients and colleagues within the firm routinely seek Kang for disputes filed in Fairfax County—Virginia’s busiest trial court for complex commercial disputes—because he knows how it operates from the inside.
At William & Mary Law School, Kang served as an editor for Law Review and competed on the National Trial Team. His undergraduate studies in German literature and philosophy round out his background.
