Post-Election Statements by Senior Democratic Leaders Reveal Congressional Investigation Priorities

  • Senior Democratic leaders in Congress are heralding an aggressive investigative agenda that will target not only the President and administration officials, but also many in the private sector.
  • Both the House and the Senate will be conducting investigations from committees covering a wide range of topics.

On Tuesday, Nov. 3, Democrats won a sweeping midterm victory that is poised to give them substantial margins in both the House and the Senate when the 120th Congress is sworn in on Jan. 3, 2027. Not long after the polls closed, senior Democratic leaders were signaling that they were gearing up for aggressive congressional investigations. Ranking Member Robert Garcia of the House Committee on Oversight and Government Reform sent a message to “LAWYER UP!,” which was shared and repeated across social media and by fellow members in their own victory speeches. Ranking Member Ron Wyden of the Senate Committee on Finance posted just “Subpoenas,” while Sen. Ed Markey, a noted leader on environmental issues, stated: “They are going to need to plant new forests for all of the subpoenas we’ll be printing.” It was clear immediately that leading Democrats saw the election results as providing a mandate for aggressive oversight.

A day later, senior Democratic leaders started to articulate specific investigative priorities. While some focus directly on President Donald Trump and his administration, many implicate the private sector directly or indirectly.

House Oversight

On Nov. 4, Garcia, who is expected to take over as chairman of House Oversight, gave remarks in Huntington Beach, California, where he identified four categories of investigations on which his committee would be “focused like a laser”:

  1. Trump Family Businesses. The committee will investigate what he characterized as the “grift and corruption” of the “Trump crime family,” citing foreign gifts, business relationships with government contractors and the business ventures of the President and his family members.
  2. Immigration Enforcement. The committee will investigate “DHS and the abuses of ICE.”
  3. Corporate Consumer Practices. The committee will investigate “corporate corruption,” which Garcia illustrated with reference to “surveillance pricing.” “While you are struggling, corporations and CEOs are making record profits,” he explained.
  4. Jeffrey Epstein. The committee will continue to investigate Jeffrey Epstein and those with ties to him, in continuation of an investigation that was already underway in the current Congress.
Senate Finance

Also on Nov. 4, Wyden announced an agenda of “Affordability and Accountability” for his anticipated tenure as chairman. “Under my leadership,” he stated, “the top priorities of the Finance Committee will be affordability for us, accountability for them.” He then outlined four specific areas of focus:

  1. Taxes. “[T]he committee will redouble its efforts to ensure billionaires pay their fair share and hold tax cheats accountable. Democrats will spearhead a tax agenda that puts American families first and requires the ultra-rich and corporations to pay their fair share.”
  2. Healthcare. “Finance Committee Democrats will create a new foundation for America’s health care system that guarantees health care for all, gives Americans cheaper and better health care, and ends the corporate chokehold on our nation’s health care system.”
  3. Trade. “I will use this committee to reassert congressional authority over our country’s trade policy to bring down costs, end Trump’s disastrous and corrupt tariffs, reestablish critical trade partnerships, and hold trade cheats accountable.”
  4. Accountability. “I’m putting the special interests that have worked hand-in-hand with Trump to rip off American families for the last year and a half on notice. From the banks that helped cover up Epstein’s crimes, to insurance companies that are delaying and denying health care to churn a profit, to the pharmaceutical company CEOs that price gouge while enjoying Trump’s hand-delivered windfalls, when I am chair, they will be forced to answer to the Senate Finance Committee for their role in hurting the American people and enabling Trump’s corruption.”

These early statements illustrate that leading Democrats are already prepared for aggressive investigations and will continue to prepare between now and Jan. 3, 2027, when the 120th Congress formally begins.
