Seth regularly litigates individual and putative class action cases on behalf of several of the largest banks in the nation, including cases alleging violations of the Fair Credit Reporting Act, Fair Debt Collection Practices Act, Truth in Lending Act, Real Estate Settlement Procedures Act and Equal Credit Opportunity Act. Multiple such cases have involved appeals before the U.S. Court of Appeals for the Fourth Circuit.
Seth also represents other creditors and service providers in cases alleging violations of the Telephone Consumer Protection Act and state consumer protection laws, and he represents many other clients involved in general business disputes and antitrust litigation. In addition to antitrust litigation, he advises clients on antitrust compliance, which has included serving as interim chief antitrust counsel for one of the world’s leading manufacturers of paper and forest products.
Prior to joining McGuireWoods, Seth was an associate in the New York office of a leading global law firm. While earning his law degree at Fordham University School of Law, Seth served as a summer student law clerk for the Honorable Douglas F. Eaton of the U.S. District Court for the Southern District of New York. Seth received the school’s Legal Writing Award and was named Best Oralist in the 2003 William B. Spong Moot Court competition at William & Mary’s Marshall-Wythe School of Law. As an undergraduate at Colgate University, Seth was a George C. Cobb Fellow and Captain of the men’s basketball team. He received the ECAC Scholar Athlete Merit Medal and the Thomas M. Wilson ’67 Memorial Leadership Award.

- Representation of major building products manufacturer in putative antitrust class action in which direct and indirect purchasers asserted price fixing claims under the Sherman Act and various state law claims.
- Representation of flood vent manufacturer in antitrust litigation in which a competitor alleged a conspiracy to allocate markets and monopolization under the Sherman Act.
- Representations of multiple national banks, a pharmaceutical company, and a foam manufacturer in responding to Department of Justice and Federal Trade Commission subpoenas and civil investigative demands in connection with merger investigations.
- Representation of multiple national banks in managing the litigation of hundreds of retail bank, credit card, mortgage, and student and auto loan matters in a multi-state territory, focusing on effective and cost-efficient resolutions.
- Representation of a national bank in a putative class action in which Plaintiff alleged violation of New Jersey’s Truth in Consumer Contract Warranty and Notice Act.
- Representation of a national home equipment manufacturer in a putative class action in which Plaintiff alleged violation of New Jersey’s Truth in Consumer Contract Warranty and Notice Act.
- Representation of healthcare trade association in antitrust litigation in which a software solution company alleged illegal boycott and monopolization under the Sherman Act and various state law claims.
- Representation of national administrator of dental benefits program in antitrust litigation brought by dentist alleging illegal conspiracy to restrain trade and various business torts.
- Representation of a national bank in a putative class action in which plaintiff alleged that the disclosures distributed to consumers in the bank’s
marketing materials violated the Truth in Lending Act. - Representation of a national bank in multidistrict litigation in which plaintiffs alleged an unlawful increase in their credit cards’ interest rates.
- Representation of a national bank in a putative class action in which plaintiffs alleged improper allocation of their credit card payments under the
Credit CARD Act of 2009. - Representation of a national bank in a putative class action in which plaintiff alleged violation of the Electronic Funds Transfer Act.
- Representation of an auto loan company in a putative class action in which plaintiff alleged violations of the Telephone Consumer Protection Act.
- Representation of major pool product manufacturer in putative antitrust class action in which direct and indirect purchasers alleged horizontal and
vertical conspiracies among the manufacturer, its competitors and its largest customer. - Representation of state high school league in antitrust litigation in which a private school claimed that the league’s public school-only membership rule
was an illegal boycott of private schools. - Representation of a major food company against a competitor’s antitrust claims of conspiracy and monopolization.
- Representation of a large national food distributor in its defense of claims brought by former employees related to their compensation agreements.
- Representation of a national bank in its defense of claims brought by a former employee related to his compensation agreement.
- Representation of a multinational aluminum products manufacturer in connection with claims by one of its vendors that the manufacturer breached a
multimillion-dollar supply contract. - Representation of one of the nation’s largest bottle closure system manufacturers in a dispute with one of its vendors in connection with the purchase of
a robotic packaging system. - Representation of a subsidiary of a Fortune 500 company that sued its former CEO for breach of fiduciary duty, fraud and conspiracy.
